In Junge & Padovan [2017] FCCA 1350 (11 July 2017), allegations were made that the father had child pornography on his computer, or a computer that he had access to. The father denied any knowledge of the offending material. After considering all of the evidence and various sections of the Family Law Act 1975 including ss.60B, 60CA, 60CC, 61DA, 65DAA, 69ZT, 69ZV, 70NAE and the authorities on this question, findings were made that the father was an unacceptable risk of harm.
