Paul Cutler was recently involved in a prosecution in the Land and Environment Court in respect of a breach of s 9(1) of the Dangerous Goods (Road and Rail Transport) Act 2008. The detailed judgment given by her Honour Pain J is a timely reminder of the seriousness with which environmental offences are treated, notwithstanding the early pleas by both the truck driver and the transport company.
